Income-tax Reassessment Under the Income Tax Act, 2025: Notice and Appeal Guide
Updated: 4 days ago
The Income Tax Department’s current guidance describes a reassessment process under the Income Tax Act, 2025. A reassessment communication should be treated as a formal legal proceeding. The taxpayer must identify the relevant tax year, notice stage, information relied upon, response deadline and available remedy before preparing a reply.
The purpose of a good response is not to submit volume for its own sake. It is to create a reliable record showing the facts, the evidence, the legal objections and the relief requested.
Reassessment procedure has changed and the notice must be read precisely
The Department’s FAQ states that, where income is believed to have escaped assessment, the Assessing Officer must generally have information suggesting escapement, provide an opportunity to respond through a show-cause notice under section 281(1), consider the reply, pass a reasoned order under section 281(3) with the required prior approval, and then issue a reopening notice under section 280.
The same official FAQ notes that exceptions may exist under section 281(4), and that approval requirements may still apply in those cases. The relevant tax year, commencement provision, transitional rule and actual notice must be checked before applying a generic timeline or argument.
Step one: authenticate and classify the communication
Download the complete communication from the e-Filing portal and preserve the DIN or document reference, date of issue, date of service, assessment year or tax year, issuing authority and response deadline. Confirm whether the communication is a preliminary show-cause notice, notice to furnish information, order, demand, rectification communication or formal reopening notice.
Do not treat an email alert as the complete notice. The operative document, attachments and portal record should be read together. Check whether the document identifies the information relied upon, the income alleged to have escaped assessment, the proposed adjustment and the opportunity provided to respond.
Your first-response file should record:
• PAN or TAN and taxpayer status.
• Tax year or assessment year and notice reference.
• Date and method of service.
• Exact response deadline and portal location.
• Order, demand or proceeding that may follow.
Build a response record before writing the legal reply
Create a chronology covering the original return, processing or assessment, earlier notices, submissions, orders, refunds, demands and relevant subsequent development. Prepare a source schedule for the information referred to by the Department. If the source is not provided or is unclear, request the material needed to give an effective response.
Prepare a transaction-level explanation. Link each disputed amount to the return, books, bank statement, contract, invoice, withholding record, investment document or other primary evidence. Where the issue relates to information reporting, reconcile the notice with the Annual Information Statement, Taxpayer Information Summary, Form 26AS, TDS certificates and relevant return schedules.
Avoid unsupported statements such as “the information is incorrect” or “the transaction is genuine.” State what happened, identify the evidence, explain the tax treatment and address the legal consequence separately.

Use e-Proceedings correctly
The Income Tax Department’s e-Proceedings manual states that registered users can view and respond to notices, intimations and letters issued by the Assessing Officer, CPC or another Income Tax authority. The portal route is generally Dashboard, Pending Actions and e-Proceedings, followed by the correct taxpayer or authorised-representative view.
Download the notice before submitting a response. Use the response field for a concise position and upload a structured paper with headings, page numbers and an evidence index. Name files consistently and keep the final PDF exactly as filed. After submission, record the transaction ID and confirmation email.
Before clicking submit, verify:
• Correct PAN, TAN and proceeding.
• Correct notice and response option.
• Complete annexures and readable PDFs.
• Declaration, authorisation and transaction confirmation.
Reassessment objections should be issue-specific
A reassessment response may involve several distinct questions: whether the information suggests escapement, whether the notice is within the applicable period, whether the correct taxpayer and tax year have been identified, whether the statutory pre-notice opportunity was provided, whether the approval requirement was satisfied and whether the proposed issue is legally and factually sustainable.
These questions should not be collapsed into a single general objection. Address jurisdiction and procedure first, then facts, then computation and finally the requested relief. If documents are missing, make a documented request for them. If a hearing is necessary, request it and maintain proof.
Appeal planning after an order or demand
The Income Tax Department’s Form 35 FAQ states that an assessee or deductor aggrieved by an order of an Assessing Officer may file Form 35 online before the Joint Commissioner (Appeals) or Commissioner of Income Tax (Appeals), as applicable. The FAQ states that the appeal is ordinarily filed within 30 days from service of the order or demand, and that delay may be condoned where there is reasonable cause.
The appeal file should include the impugned order, demand notice, statement of facts, grounds of appeal, evidence relied upon, computation, proof of payment of the applicable appeal fee and any request for admission of additional evidence or delay condonation. Grounds should be concise, numbered and directed to the order under challenge.
Appeal preparation checklist:
• Calculate the deadline from legally relevant service.
• Preserve proof of service and portal download.
• Prepare statement of facts and numbered grounds.
• Attach order, demand, evidence and fee proof.
• Analyse stay, recovery, condonation and additional evidence separately.
Income-tax litigation-readiness checklist
• Download the complete notice, annexures and portal history.
• Reconcile AIS, TIS, Form 26AS, TDS certificates and return data where relevant.
• Separate jurisdictional objections from factual and computation objections.
• Track follow-up notices, hearing opportunities, orders and demand status.
