Income Tax Demand: Rectification or Appeal?
Updated: 3 days ago

When an income-tax order raises a demand, first identify whether the problem is an apparent error in the record or a substantive disagreement with the decision. Rectification and appeal serve different purposes. Selecting the wrong route can leave the real dispute unresolved while a separate filing deadline continues to run.
This article focuses on demands for AY 2026–27 and earlier years governed by the Income-tax Act, 1961. It does not apply the old section numbers indiscriminately to Tax Year 2026–27 under the Income-tax Act, 2025.
Begin with the year, order and service date
Collect the complete intimation or assessment order, demand notice, computation, filed return, tax-credit information and payment challans. Record when each document was served and which authority passed it.
The Income Tax Department's transition guidance confirms that proceedings relating to AY 2026–27 and earlier assessment years continue under the 1961 Act framework despite the new Act's commencement. The calendar date on which an appeal is filed does not, by itself, determine the governing legislation.

When rectification may be relevant
Section 154 concerns mistakes apparent from the record. The Department's portal guidance identifies reprocessing, tax-credit mismatch correction and permitted return-data correction as available request categories, depending on the case and portal workflow.
An example is a correctly claimed payment whose challan particulars were not matched during processing. Establish the discrepancy using the filed return, challan and credit record; do not assume that every disallowed claim is a simple processing error.
Compare the return computation with the processed computation.
Reconcile TDS, TCS, advance tax and self-assessment payments.
Identify the exact line that needs correction and its supporting record.
Select the competent authority and appropriate portal category.
Preserve the request, reference number and subsequent order.

When an appeal needs separate consideration
A contested factual finding, interpretation of law or rejection of an explanation may require an appeal rather than a request to correct an obvious error. Confirm that the order is appealable and identify the proper appellate authority.
The Department's Form 35 guidance describes first appeals to JCIT(A) or CIT(A), as applicable, and the ordinary 30-day period measured from service of the relevant order or demand, as the case may be. Exceptional delay may require a supported condonation application; acceptance is not automatic.

Keep separate control of limitation and recovery
Do not assume that a rectification request pauses or restarts the limitation for appealing the original order. Calendar the original remedy independently. Where appropriate, obtain advice on preserving appeal rights while an apparent-error issue is being considered.
Likewise, filing an appeal or rectification request should not be treated as automatic protection against collection. Review the demand, payment position and any separate stay or recovery application needed in the particular case.
Build the evidence file before drafting grounds
The strongest file explains the difference between the return, departmental computation and taxpayer's position. Create one dated chronology and a numerical bridge for each disputed amount.
For example, if a demand combines an unmatched tax payment and a disputed disallowance, separate them. The payment issue may be capable of correction on the record; the disallowance may require a merits challenge. This illustration is not a conclusion that both remedies are available in every case.

Frequently asked questions
Can rectification be used to introduce any fresh deduction?
No. It is not a general substitute for revising the return or challenging an assessment. Portal guidance restricts new claims; the permissible route depends on the facts and statute.
Should I wait for rectification before considering an appeal?
Assess both deadlines immediately. Waiting without reviewing limitation can prejudice the challenge to the original order.
Does the 2025 Act automatically govern an older-year demand received in 2026?
No. Identify the tax period. The Department's transition guidance preserves the 1961 Act framework for AY 2026–27 and earlier years.
Why choose a structured review with PGT & Associates?
A demand review should connect accounting records, tax credits, the order and the available remedy. Share the complete papers with PGT & Associates to discuss the scope of reconciliation, drafting and representation support appropriate to the matter. No cancellation of demand, refund or appellate result is guaranteed.
