Income-tax Form 161 After Notification 134/2026: Ahmedabad Filing and Litigation Checklist

CBDT Notification No. 134/2026, dated 8 October 2026, makes the Income-tax (Sixth Amendment) Rules, 2026. It amends rule 231 by adding the words “or waiver” after “imposition” and substitutes Form No. 161 for an application seeking waiver of penalty under section 440(2) of the Income-tax Act, 2025.

For taxpayers and advisors handling assessment or reassessment orders, the practical importance is the new structured form. It is not a general penalty amnesty and it does not decide eligibility or outcome by itself. The information entered must be reconciled with the order, notice of demand, payments and litigation position.

Fields introduced or organised in the revised Form 161

The form asks for personal information including full name, PAN, address and contact details. Its assessment and payment section asks for the tax year, the section under which the order was passed, the Document Identification Number, order date, service date and due date for payment stated in the notice of demand.

It also asks for income assessed, under-reported income and the relevant misreporting classification, tax and interest payable on assessed income, tax payable on under-reported income, additional income-tax payable in lieu of penalty and the total amount payable for waiver of penalty. The form includes a payment section for BSR code, deposit date, challan serial number and amount.

The verification must be treated as substantive

The verification states that the applicant has not filed an appeal in respect of the order identified in Part B and undertakes not to file an appeal in respect of that order before the expiry of the period specified in section 440(5). That is more than a formatting step. Before filing, the taxpayer and advisor should reconcile the order, service date, demand, payments, any existing appeal or proceeding and the intended litigation strategy.

Form 161 readiness checklist for an Ahmedabad tax practice

  • Download the current form and record the notification and form version used.

  • Match the order, DIN, order date, service date and demand due date across the official records.

  • Reconcile the computation of tax, interest, additional income-tax and total amount payable with the notice of demand and computation sheet.

  • Check every challan field against payment evidence and retain the supporting documents.

  • Confirm the appeal declaration with the person competent to verify the application.

  • Do not assume that pre-filled information is correct; compare it with the order and payment record.

  • Monitor the official Income Tax Department portal for later filing instructions or clarifications.

How far the notification goes

Notification 134/2026 tells us the amended rule wording, the substituted form and the data the application asks for. It does not, by itself, grant waiver, determine whether a taxpayer satisfies the statutory conditions, or remove other compliance steps. The result remains dependent on the facts, records and applicable provisions.

The form notes that some information may be pre-filled to the extent possible and that amounts should be provided in rupees unless otherwise specified. A careful file should retain the source documents used to validate every material field, particularly the order, demand due date, payment details and appeal declaration.
