Income-tax Act, 2025: what Ahmedabad taxpayers should track

The Income-tax Act, 2025 and the Income-tax Rules, 2026 create a new framework that businesses, professionals and taxpayers in Ahmedabad must read with care. The notified Rules, 2026 were made under section 533 of the new Act and came into force on 1 April 2026. The operative tax year, transitional provision and exact notice remain essential to any case-specific analysis.

The new Income-tax Rules, 2026

The official notification defines the new Rules and provides the framework for forms, records and procedures under the Income-tax Act, 2025. The rules include detailed documentation provisions, including requirements that relevant transfer-pricing information and documents should, as far as possible, be contemporaneous and maintained for the prescribed period.

For Ahmedabad businesses with domestic or international transactions, the practical lesson is to preserve contracts, pricing studies, invoices, correspondence, financial statements and comparable data contemporaneously. A document created only after a notice may not explain the commercial position as reliably as a properly maintained contemporaneous record.

Revised Form 161 and penalty-waiver applications

The Income Tax Department’s latest updates state that CBDT Notification No. 134/2026 dated 8 October 2026 introduced a revised Form 161 for applications for waiver of penalty under section 440(2) of the Income-tax Act, 2025. This is a current procedural development, not a general waiver of penalties. Eligibility, facts, statutory conditions and the application record must be checked in every matter.

A professional response should explain the default, the reason for the failure, the taxpayer’s conduct, the corrective steps taken and the evidence supporting the request. The application should not assume that financial difficulty or inadvertence alone satisfies the legal test.

Notice and litigation-readiness file

Before replying to an income-tax notice, download the complete communication and preserve the DIN, tax year, date of service, portal location and deadline. Reconcile the notice with the return, books, bank statements, AIS, TIS, Form 26AS, TDS records and supporting contracts. Separate procedural objections from factual explanation and computation.

A strong file should include:

• Chronology of returns, notices, replies, orders and payments.

• Issue-wise reconciliation and primary evidence.

• Notice authentication and proof of service.

• e-Proceedings submission acknowledgement and transaction ID.

Practice guide for professionals

Appeals and professional support in Ahmedabad

An appeal should be drafted from the impugned order and demand, not merely copied from an earlier response. State the facts, numbered grounds, computation and relief sought. Preserve the date of service because limitation usually turns on the legally relevant service event. A CA in Ahmedabad or tax-litigation professional should also separately assess recovery, stay, condonation and additional-evidence issues where relevant.

This article is general information, not a case-specific tax opinion. Transitional rules, tax year, notice date and the exact statutory provision should be checked before relying on any procedure.
