GST Show-Cause Notice and Appeal: A Practical Litigation-Ready Guide

A GST show-cause notice can affect tax, interest, penalty, input tax credit, refund eligibility and the taxpayer’s future litigation position. It should therefore be treated as a litigation document rather than an ordinary compliance message. The first response should be controlled, evidence-based and aligned with the exact allegation in the notice.

The objective is not to submit the longest possible reply. The objective is to create a clear record showing what is alleged, what the evidence proves, what the law requires and what relief is requested.

A GST notice is a litigation document, not an ordinary compliance message

The correct strategy depends on the tax period, statutory provision, issuing authority, demand computation, documents relied upon and relief requested. A response should never assume that every mismatch is tax evasion or that every notice can be resolved by making a payment.

Before drafting, identify whether the communication is a pre-notice intimation, a show-cause notice, a demand order, a recovery communication or an appeal-related document. The legal consequences and available remedies can be different at each stage.

First review: identify the legal and factual foundation

Begin with the notice number, date, tax period, GSTIN, issuing authority and statutory provision. Check whether the notice identifies the exact transaction, document, return or data source relied upon. A notice that contains only an aggregate figure should be tested against the underlying records before a substantive response is finalised.

Prepare a demand matrix with separate columns for tax, interest, penalty, period, invoice or document reference, allegation, supporting evidence and proposed response. This prevents a broad narrative from hiding a numerical error or an unsupported assumption.

Useful first-review questions include:

• What exact provision has been invoked?

• Which tax period and GSTIN are covered?

• Is the amount supported by a document-level schedule?

• Is the allegation about tax, interest, penalty, credit, refund or procedure?

Preserve the complete evidence trail

Download the notice and every annexure from the GST Portal. Preserve the original file name, download date and acknowledgement details. Collect the relevant returns, ledgers, invoices, e-way bills, contracts, purchase orders, delivery records, payment evidence, credit notes, reconciliations and prior correspondence.

Where the allegation relies on a data comparison, recreate the comparison independently. A mismatch between GSTR-1, GSTR-3B, e-invoice data, e-way bill data, books or departmental data should be tested at document level. A gross difference is not automatically the same as a taxable short-payment.

For input-tax-credit disputes, separate commercial receipt, tax-invoice requirements, supplier reporting, payment conditions, blocked-credit rules, reversals, credit notes and timing issues. For export or refund matters, preserve the contract, invoice, shipping and realisation documents, declarations and the exact computation submitted with the claim.

Respond allegation by allegation

A strong reply usually has four layers: a short preliminary statement, a factual chronology, a legal analysis and a document index with a clear prayer for relief. Identify the department’s proposition, state whether it is accepted or disputed, explain the evidence and quantify the correct position.

If part of the demand is admitted, segregate the admitted portion from the disputed portion and state the basis for each. If documents relied upon by the department were not supplied, request access or inspection in a structured manner. If an opportunity of hearing is required, request it clearly and keep proof of the request.

A professional response should normally contain:

• A case summary and chronology.

• A response to each allegation and computation.

• Legal grounds separated from factual explanations.

• A document index with page references.

• A specific request for dropping the proceedings, correcting the computation or granting a hearing.

DRC forms and payment decisions require care

The GST Portal may present different electronic forms and payment pathways depending on the nature and stage of the proceeding. Verify the exact form, statutory provision, tax period and demand ID before filing a reply or making payment.

Payment can have consequences for interest, penalty, appeal rights and the record of the dispute. It should be analysed against the available statutory route and the taxpayer’s litigation position. A payment acknowledgement should be matched to the correct demand and preserved with the working papers.

If an order is passed: build the appeal file immediately

The GSTN appeal manual describes an online process for filing an appeal against a demand order in Form GST APL-01. The workflow includes selecting the order, identifying disputed categories, uploading the annexure and supporting documents, entering disputed amounts, addressing pre-deposit and completing electronic filing.

The appeal should be drafted from the order, not merely copied from the reply to the show-cause notice. Identify each finding that is challenged, explain the error, state the relief sought and attach a clean calculation. Include the order, notice, reply, hearing record, evidence, reconciliation, payment proof and authorisation documents.

Before filing, confirm:

• Correct order number and demand ID.

• Correct disputed amount and tax-period allocation.

• Applicable pre-deposit and admitted-liability payment.

• Complete annexure, authorisation and supporting documents.

• ARN, acknowledgement and next date after submission.

GST litigation checklist

• Preserve the notice, annexures, portal downloads and service record.

• Maintain document-level reconciliation and calculations.

• Separate tax, interest, penalty and procedural issues.

• Calendar every reply, hearing, appeal and recovery date.

• Keep the final filed PDF, ARN and transaction records together.
