GST litigation in Ahmedabad: why the record matters
For a business in Ahmedabad or elsewhere in Gujarat, a GST input-tax-credit dispute can move from a reconciliation issue to a formal notice, adjudication order or appeal. The correct response depends on the tax period, the exact statutory allegation, the stage of the proceeding and the documents supporting the credit. A professional CA in Ahmedabad or tax-litigation adviser should begin with the record rather than a generic reply.
What CBIC Circular No. 237/31/2024-GST clarifies
The CBIC circular addresses the retrospective insertion of sections 16(5) and 16(6) of the CGST Act and the treatment of cases involving alleged contravention of section 16(4). It explains different procedural situations, including cases where investigation has started but no demand notice has been issued, cases where a notice has been issued but no order has been passed, and cases where an order exists without an appeal having been filed.
The circular also describes a special rectification procedure under section 148 for specified orders where the credit may now be available under the retrospectively inserted provisions and an appeal against the order has not been filed. It is not a blanket approval of every disputed credit. Other grounds for denial may still need to be examined.
Practical file for an Ahmedabad GST notice
Create a transaction-level reconciliation before submitting a reply or rectification application. Match invoices to the books, GSTR-2B or other relevant records, supplier reporting, payment evidence, receipt of goods or services and the return in which credit was claimed. Preserve the notice, order, DRC-01A intimation, demand summary and portal acknowledgements.
A useful checklist includes:
• Identify whether the matter is at investigation, DRC-01A, notice, order, rectification or appeal stage.
• Separate section 16(4) timing issues from other eligibility conditions.
• Prepare invoice-level workings and a clean demand comparison.
• Preserve supplier, payment, receipt and return evidence.
Rectification and GST appeal workflow
The CBIC circular describes electronic rectification routes through GST Portal applications and states that supporting information in the prescribed proforma should be uploaded. The GSTN appeal manual separately explains Form GST APL-01, including selection of the order, disputed categories, annexure upload, disputed amount, payment and pre-deposit steps.
Before filing, confirm whether an appeal has already been filed, because the applicable rectification route and appeal route can interact. The GSTN manual also warns that a rectification application can affect the order against which an appeal is filed. The correct route should be decided from the actual order and current portal options.
For a litigation-ready submission:
• Use a numbered reply with an evidence index.
• State the precise relief: drop, rectify, recompute or grant hearing.
• Reconcile tax, interest, penalty and pre-deposit separately.
• Retain ARN, payment proof and all portal acknowledgements.
