Form 3CD Clause 20 for AY 2026-27: PF/ESI Employee Contributions & Section 36(1)(va)
Updated: Sep 28
Direct answer: For AY 2026-27, Clause 20(b) of Form 3CD requires tax-audit reporting of employees’ contributions received toward PF, ESI, superannuation or other employee-welfare funds, together with the statutory due date and actual payment date. If the employee contribution is deposited after the due date under the relevant welfare law, section 36(1)(va) can disallow the deduction even where payment is made before the income-tax return due date.
Update — 28 September 2026: CBDT changed the specified AY 2026–27 tax-audit report deadline from 30 September to 21 October 2026, and the related audited return deadline from 31 October to 21 November 2026. The separate Form 3CEB timeline is unchanged. Official Income Tax Department announcement.

Why Clause 20(b) matters for AY 2026-27
Payroll liabilities are often reconciled only to the general ledger. Clause 20(b) requires a more exact test: contribution-wise receipt, the due date under the applicable PF/ESI or other welfare law, and the actual deposit date. The Income Tax Department’s AY 2026-27 ITR-3 validation rules expressly map the section 36(1)(va) adjustment to Form 3CD Clause 20(b).
What does Clause 20 of Form 3CD report?
Clause 20 has two distinct reporting areas. Clause 20(a) deals with bonus or commission paid to an employee where the amount would otherwise have been payable as profits or dividend under section 36(1)(ii). Clause 20(b) deals with sums received from employees as contributions to provident fund, superannuation fund, ESI or another employee-welfare fund, and requires the relevant due date and actual payment date.
Employee contribution vs employer contribution: do not mix the tests
The employee’s contribution is money deducted or collected from the employee and is governed by section 36(1)(va) for deduction timing. Employer contributions operate under a different statutory framework, including section 43B where applicable. A tax-audit working paper should therefore keep employee and employer portions in separate columns instead of relying on one combined challan total.
The due-date test under section 36(1)(va)
For employee contributions, the critical date is the due date prescribed by the relevant welfare law. The AY 2026-27 return-validation logic treats amounts paid after that due date as a section 36(1)(va) adjustment linked to Clause 20(b). Accordingly, paying the employee contribution before the section 139(1) return due date should not be treated as a universal cure for a welfare-law delay.
Practical example
Assume a company deducts employee PF of ₹2,40,000 for a payroll month. The applicable welfare-law due date is 15 May, but the amount is deposited on 20 May. The books may show the liability as fully paid before year-end or before the income-tax return due date. Clause 20(b), however, still requires the actual payment date to be compared with the relevant statutory due date. The tax computation should separately evaluate the section 36(1)(va) consequence.
Clause 20(b) reconciliation: 8 checks before filing
1. Extract employee-wise or payroll-month-wise PF/ESI deductions from payroll. 2. Reconcile the payroll total to the employee-contribution ledger. 3. Separate employee contributions from employer contributions. 4. Map the statutory due date applicable to each contribution. 5. Capture the actual challan/payment date and challan reference. 6. Flag every payment made after the welfare-law due date. 7. Reconcile the proposed disallowance with the income-tax computation and ITR. 8. Preserve payroll registers, challans and payment evidence in the tax-audit file.
Common Clause 20(b) mistakes
Common errors include testing only the year-end closing balance, using the income-tax return due date instead of the welfare-law due date, combining employee and employer contributions, relying on ledger narration without challan verification, and failing to reconcile Form 3CD with the return computation.
AY 2026-27 transition point
FY 2025-26 / AY 2026-27 continues to use the existing tax-audit forms under the Income-tax Act, 1961: Form 3CA or Form 3CB together with Form 3CD. The Income Tax Department states that the ordinary tax-audit report due date for AY 2026-27 is 21 October 2026. The new unified Form 26 applies to Tax Year 2026-27 under the Income Tax Act, 2025, not to the FY 2025-26 audit.
How Clause 20 connects with the rest of Form 3CD
Clause 20 should not be reviewed in isolation. Payroll and employee-benefit balances can affect the tax computation, while other timing-sensitive liabilities may fall under Clause 26/section 43B. PGT & Associates has separate guides on Form 3CD Clause 26, common Form 3CD mistakes, and the AY 2026-27 tax-audit due date; these should be used together when building the final reconciliation file.
FAQs
Is PF paid before the ITR due date always deductible?
No. For employee contributions covered by section 36(1)(va), the relevant welfare-law due date must be tested. The return due date should not be substituted for that statutory test.
Does Clause 20(b) cover only PF?
No. It extends to employee contributions to provident fund, superannuation fund, ESI and other funds for employee welfare covered by the provision.
Should employer PF be reported in the same Clause 20(b) working?
Keep employer and employee contributions separately reconciled. Clause 20(b) specifically focuses on sums received from employees, while employer-contribution deduction timing is governed separately.
What is the tax-audit due date for AY 2026-27?
For an ordinary tax-audit case, the Income Tax Department states 21 October 2026. Different timelines can apply in specified transfer-pricing cases.
Key takeaway
Clause 20(b) is fundamentally a payroll-to-tax reconciliation. A clean audit file should establish what was deducted from employees, when the welfare law required deposit, when payment actually occurred, and whether the tax computation reflects any delay. That evidence is more valuable than a year-end ledger balance alone.
