Form 3CD Clause 8 for AY 2026-27: Which Section 44AB Clause Applies?

Aug 24
6 min read

Updated: Sep 28

Direct answer: Clause 8 of Form 3CD identifies the exact clause of section 44AB under which the tax audit is conducted. For AY 2026-27, getting this classification right matters because business-threshold audits, professional audits, presumptive-tax opt-outs and cases already audited under another law do not all arise under the same limb of section 44AB.

Why Clause 8 matters in AY 2026-27

FY 2025-26 remains a tax-audit year under the Income-tax Act, 1961. The Income Tax Department’s current tax-audit material confirms that Form 3CA or Form 3CB is accompanied by Form 3CD, and specifically describes Clause 8 as requiring the tax auditor to indicate the relevant clause of section 44AB under which the audit has been conducted. This is not a cosmetic field: it records the legal basis for the audit and should agree with turnover, profession, presumptive-tax and statutory-audit facts elsewhere in the file.

Which Section 44AB clause should be selected?

Section 44AB(a): business turnover

Clause (a) is the ordinary business-audit limb. It applies where total sales, turnover or gross receipts from business exceed the prescribed threshold. The ordinary threshold is ₹1 crore, but the first proviso raises the threshold to ₹10 crore where both aggregate cash receipts and aggregate cash payments do not exceed 5% of their respective totals. The 5% test therefore has two sides—receipts and payments—and should be documented before the audit basis is finalised.

Section 44AB(b): professional receipts

Clause (b) applies to a person carrying on profession where gross receipts exceed ₹50 lakh. This should not be confused with section 44ADA’s presumptive-tax ceiling. The question under Clause 8 is the legal trigger for audit, not merely the taxpayer’s preferred method of computing income.

Section 44AB(c): lower profit under specified presumptive schemes

Clause (c) covers specified cases where profits are claimed below the deemed-profit framework under sections such as 44AE, 44BB or 44BBB and the statutory conditions for audit are met. The working paper should identify the exact presumptive provision involved and reconcile the declared profit with the return computation.

Section 44AB(d): Section 44ADA cases

Clause (d) addresses the professional presumptive-tax situation under section 44ADA where profits are claimed below the prescribed presumptive level and the statutory income condition for audit is satisfied. Professionals should avoid mechanically selecting clause (b) merely because the taxpayer carries on a profession; the audit trigger may instead arise from the presumptive-tax rule.

Section 44AB(e): Section 44AD(4) cases

Clause (e) is relevant where section 44AD(4) applies after a taxpayer exits the presumptive scheme and the related statutory conditions trigger audit. This is a common classification risk because the taxpayer may have turnover below the ordinary section 44AB(a) threshold but still have an audit obligation through the presumptive-tax consequences.

What about companies and LLPs already audited under another law?

A company may already be subject to statutory audit under the Companies Act, and an LLP may have a separate statutory audit requirement. The third proviso to section 44AB addresses a person who is required by or under another law to get accounts audited. In such cases, the tax-audit file should expressly reconcile the statutory audit with the section 44AB reporting obligation instead of treating the exercise as if no other audit existed.

Clause 8 vs Form 3CA/3CB: do not mix the two decisions

Two related decisions are often collapsed into one. First, Clause 8 asks why section 44AB applies. Second, Form 3CA versus Form 3CB asks whether the accounts are already required to be audited under another law. Form 3CA is used where accounts are audited under another law; Form 3CB is used in other cases. Both are accompanied by Form 3CD.

Practical examples

Example 1: low-cash business with ₹7 crore turnover

Assume a business has ₹7 crore turnover, cash receipts of 2% and cash payments of 3%. Because both cash tests are within 5%, the enhanced ₹10 crore threshold can apply. On these facts, turnover alone would not trigger section 44AB(a). The audit team should not select Clause 8 on the assumption that every business above ₹1 crore is automatically subject to tax audit.

Example 2: ₹3 crore turnover but 8% cash payments

If turnover is ₹3 crore, cash receipts are 2% but cash payments are 8%, the enhanced ₹10 crore threshold is unavailable because both conditions must be satisfied. The ordinary ₹1 crore threshold then becomes relevant, subject to the full statutory facts.

Example 3: professional below ₹50 lakh but presumptive issue

A professional with receipts below ₹50 lakh is not automatically outside tax audit. If the taxpayer is within the section 44ADA framework, declares profit below the presumptive level and satisfies the statutory income condition, the audit analysis shifts to section 44AB(d), not simply section 44AB(b).

Clause 8 pre-filing checklist

  • Document whether the assessee carries on business, profession or both.

  • Reconcile turnover/gross receipts to the financial statements, GST data and return computation.

  • For business cases, compute both the cash-receipts percentage and cash-payments percentage before relying on the ₹10 crore threshold.

  • Check whether sections 44AD, 44ADA, 44AE, 44BB or 44BBB affect the audit trigger.

  • Identify whether accounts are already audited under the Companies Act, LLP law or another statute.

  • Ensure the Clause 8 selection agrees with Form 3CA/3CB selection and the tax-audit working papers.

  • Review prior-year presumptive-tax choices, especially the consequences of section 44AD(4).

  • Keep a short written conclusion in the audit file explaining why the selected limb of section 44AB applies.

Common Clause 8 mistakes

  • Using section 44AB(a) merely because the assessee is a business without first testing the 5% cash conditions.

  • Treating the ₹10 crore threshold as a “digital business” test instead of a statutory cash-receipts and cash-payments test.

  • Selecting section 44AB(b) for every professional even where the audit trigger actually arises from section 44ADA.

  • Ignoring the effect of section 44AD(4) when a taxpayer moves out of presumptive taxation.

  • Failing to align Clause 8 with the choice between Form 3CA and Form 3CB.

FAQs

What does Clause 8 of Form 3CD ask?

It asks the tax auditor to identify the relevant clause of section 44AB under which the audit has been conducted.

Is Clause 8 the same as choosing Form 3CA or Form 3CB?

No. Clause 8 identifies the statutory audit trigger under section 44AB. Form 3CA versus Form 3CB depends on whether the accounts are required to be audited under another law.

Does every business above ₹1 crore require tax audit?

Not necessarily. The enhanced ₹10 crore threshold may apply where both cash receipts and cash payments are within the statutory 5% limits. Other exceptions and presumptive-tax provisions must also be checked.

Can a presumptive-tax case trigger tax audit below the normal turnover threshold?

Yes. Sections 44AD, 44ADA and specified presumptive provisions can create audit consequences based on their own statutory conditions.
