Tax Audit Penalty for AY 2026-27 under Section 271B
People searching for the AY 2026-27 tax audit penalty are usually asking a different question from the due date. The date is when the report has to be furnished. The penalty is what section 271B can levy if the accounts are not audited, or the audit report is not furnished, as required by section 44AB. This note covers the penalty. The date is covered separately.
What section 271B provides
If a person fails to get the accounts audited, or fails to furnish the audit report, as required under section 44AB, section 271B provides for a penalty of one-half of one percent of the total sales, turnover or gross receipts in the business, or of the gross receipts in the profession, for that previous year. The penalty is that amount or Rs 1,50,000, whichever is less.
The cap matters more than the percentage for smaller cases. Half a percent of turnover reaches Rs 1,50,000 once turnover or gross receipts cross Rs 3 crore. Above that, the statutory ceiling in section 271B is Rs 1,50,000, not a rising percentage without a limit.
The AY 2026-27 date this penalty is measured against
The firm's published note on the extension says the CBDT's 28 September extension moved the ordinary AY 2026-27 tax-audit report date from 30 September to 21 October 2026, and the related audited return from 31 October to 21 November 2026. Form 3CEB is on its own timeline. Read that note before treating a date in an older headline as still current: https://www.pgtandassociates.com/post/tax-audit-due-date-ay-2026-27-30-september-31-october
Section 271B looks at whether the section 44AB audit was obtained and the report was furnished by the due date that applies to that assessee. An extended date, a transfer-pricing date, or a different form can change the day the default starts. Do not apply the ordinary 21 October date to a case the extension note puts on another timeline.
When the penalty need not be levied
Section 273B provides that no penalty shall be imposed under section 271B if the person proves that there was reasonable cause for the failure. A late report is not, by itself, the end of the matter. The assessee still has to show cause. Illness, a delay that is documented, or a cause the assessing officer accepts as reasonable, is a facts question. It is not an automatic waiver, and it is not a reason to miss the date.
What this penalty is not
It is not the fee for a late return under section 234F. That fee follows the return, not the audit report.
It is not interest under sections 234A, 234B or 234C. Those charge for late filing or short payment of tax.
It is not a penalty under section 270A for under-reporting income. A late audit report and an addition in the assessment are separate proceedings.
It is not the penalty for a failure inside Form 3CD, such as a clause that was left blank. Section 271B is about the section 44AB audit and furnishing the report.
How to use this with the rest of the audit file
Fix the date first, using the extension note above. Then check whether section 44AB applies at all, including the presumptive cases under section 44AD(4), which the firm has covered separately: https://www.pgtandassociates.com/post/section-44ad-4-income-tax-act. Changes in the report for AY 2026-27 are here: https://www.pgtandassociates.com/post/tax-audit-report-changes-ay-2026-27.
If the report is already late, record the cause while it is still fresh, compute the section 271B amount at one-half percent subject to the Rs 1,50,000 ceiling, and keep that computation with the audit file. If the case needs to be looked at against the firm's own working papers, use the Tax Audit AY 2026-27 enquiry on https://www.pgtandassociates.com/.
This is a general note on the statute for readers comparing dates and penalties. It is not an opinion on a particular assessment. Penalty orders turn on the notice, the year, and the cause that was actually shown.
