Form 3CD Clause 33 for AY 2026-27: Chapter VI-A Deductions & Reconciliation

Updated: Sep 28

Clause 33 is the tax-audit disclosure for deductions admissible under Chapter VI-A or Chapter III (section 10AA). For AY 2026-27, businesses should not treat it as a simple copy of the return: each deduction should be traced to eligibility conditions, supporting records and the amount ultimately claimed in the ITR.

Update — 28 September 2026: CBDT changed the specified ordinary AY 2026–27 tax-audit report deadline from 30 September to 21 October 2026 and the related audited return deadline from 31 October to 21 November 2026. Transfer-pricing Form 3CEB remains separate. Official Income Tax Department announcement.

Why Clause 33 matters for AY 2026-27

FY 2025-26 / AY 2026-27 remains under the Income-tax Act, 1961 tax-audit framework. Taxpayers subject to section 44AB continue to use Form 3CA or 3CB with Form 3CD, and the ordinary tax-audit report due date is 21 October 2026. The new unified Form 26 applies from Tax Year 2026-27, not AY 2026-27.

What should be reconciled under Clause 33?

The audit team should prepare a deduction-wise schedule showing the relevant section, gross eligible base, statutory limits or conditions, amount admissible and amount claimed. Depending on the assessee, this can include business-linked Chapter VI-A deductions and section 10AA. The schedule should agree with the computation of income and the applicable ITR schedules.

A practical Clause 33 reconciliation workflow

1. Extract every deduction claimed in the draft return or tax computation. 2. Map each item to the exact statutory section. 3. Verify threshold, time-period and business-activity conditions. 4. Tie the qualifying amount to ledgers, certificates, approvals and supporting schedules. 5. Identify deductions restricted by the tax regime or by the assessee category. 6. Reconcile the admissible figure with Form 3CD and the ITR before upload. 7. Preserve the working paper showing why any book amount differs from the tax deduction claimed.

Example: why book expenditure and tax deduction may differ

Assume a business records ₹12 lakh of expenditure connected with an activity for which a specific Chapter VI-A deduction is claimed. Clause 33 should not automatically report ₹12 lakh. The auditor must first test the relevant section, eligible base, statutory percentage, qualifying period and other conditions. The report should reflect the amount admissible under the provision, supported by a clear computation.

Common Clause 33 errors

Frequent problems include using the accounting ledger balance as the deduction, applying a deduction without checking assessee-specific conditions, missing changes caused by the chosen tax regime, failing to reconcile the audit report with the ITR, and retaining no evidence for the eligibility computation. These errors are especially avoidable when the audit file contains one deduction register rather than separate unconnected workings.

Pre-filing checklist

Confirm the applicable Act and assessment year; map each deduction to its section; verify eligibility and limits; reconcile with books and computation; cross-check the ITR schedule; document management representations where relevant; review prior-year positions for consistency; and complete the final Form 3CD-to-ITR tie-out before filing.

FAQs

Is Clause 33 only for individual deductions such as section 80C?

No. In a tax-audit context, Clause 33 is relevant to deductions admissible under Chapter VI-A or Chapter III section 10AA, as applicable to the assessee. The actual sections relevant to a business depend on its facts and tax profile.

Which tax-audit forms apply for AY 2026-27?

For FY 2025-26 / AY 2026-27, the Income Tax Department confirms continued use of Form 3CA or Form 3CB together with Form 3CD under the Income-tax Act, 1961.

What is the ordinary tax-audit due date for AY 2026-27?

For ordinary tax-audit cases, the Department states 21 October 2026. Transfer-pricing cases can have a different audit timeline.
