Where the gross total income of an assessee to whom section 44AB applies includes any profits and gains derived from business, there shall, in accordance with and subject to the conditions specified in this section, be allowed a deduction of an amount equal to thirty per cent of additional employee cost incurred in the course of such business in the previous year, for three assessment years including the assessment year relevant to the previous year in which such additional employee cost is incurred.

Total Cumulative Tax Shield: ₹9.00 Crore over three years, substantially lowering corporate tax outlays.
#### 2. Eligibility Prerequisites
The assessee must derive income from business (not applicable to pure professional firms or investment entities).
The accounts must be audited under Section 44AB.
The business must not be formed by splitting up or reconstruction of an existing business, or by acquisition/amalgamation of an existing entity.
Who Qualifies as an 'Additional Employee'?
The statutory definition of an additional employee under Explanation (i) to Section 80JJAA enforces strict qualitative and quantitative tests:
#### Qualifying Criteria:
Recognized Provident Fund Participation: The employee must be enrolled in a recognized provident fund (EPFO) where statutory contributions are deposited.
Emoluments Ceiling (₹25,000 Rule): The total monthly emoluments paid or payable to the employee must not exceed ₹25,000. If monthly pay (basic + allowances) reaches ₹25,001 even in a single month, the employee is disqualified from the Section 80JJAA claim.
Minimum Period of Employment (240 Days):
General Rule: The employee must be employed for a minimum period of 240 days during the relevant previous year (typically joined on or before August 4th of the financial year).
Apparel, Footwear & Leather Industry Exception: For businesses engaged in the manufacturing of apparel, footwear, or leather goods, the threshold is reduced to 150 days.
Second-Year Rollover Proviso: If a newly recruited employee worked for less than 240/150 days in the year of joining, but is employed for at least 240/150 days in the immediately succeeding financial year, they are deemed to be an additional employee in that succeeding year, allowing the 3-year deduction cycle to commence then.
#### Disqualified Employees:
Employees whose total monthly pay exceeds ₹25,000.
Employees who do not participate in a recognized provident fund.
Employees for whom the entire government provident fund contribution is paid under Central schemes (such as the Pradhan Mantri Rojgar Protsahan Yojana - PMRPY).
Computing 'Additional Employee Cost': Baseline Headcount & Digital Payments
Under Explanation (ii) to Section 80JJAA, additional employee cost represents the total emoluments paid or payable to qualifying additional employees. However:
Net Increase in Headcount Mandatory: If the total headcount at the end of the year does not exceed the total headcount on the first day of the financial year, the additional employee cost is treated as Nil.
Digital Payment Gateways: Emoluments must be disbursed strictly via account payee cheque, bank draft, electronic clearing system (ECS), or prescribed electronic modes under Rule 6ABBA (NEFT, RTGS, IMPS).
