CBDT Notification 133/2026: What It Changes for Income-Tax Appeals
Updated: 3 days ago
CBDT Notification No. 133/2026, dated 30 September 2026, amends the Government notification governing the administrative hierarchy for certain income-tax appellate officers. It specifies that Joint Commissioners of Income-tax (Appeals) and Additional Commissioners of Income-tax (Appeals) are subordinate to the Principal Chief Commissioners of Income-tax or Chief Commissioners of Income-tax within whose jurisdiction they perform their functions.
The operative wording
The notification says that it is made under section 238 of the Income-tax Act, 2025. It substitutes clause (ba) in the earlier notification and states that the change comes into force from the date of publication in the Official Gazette. The document identifies itself as Notification No. 133/2026 and records the file reference of the Central Board of Direct Taxes.

Why the change matters in an appeal file
This is an administrative-jurisdiction update. It should not be described as a decision on the merits of any taxpayer’s appeal, as a new limitation period, or as a blanket change to every appellate remedy. The practical value is that a tax professional preparing a representation should identify the officer, designation, jurisdiction and communication correctly before sending a response or asking for procedural relief.
Preserve the complete notice, order or appeal communication, including the date and electronic reference number.
Record the assessment year, provision invoked, stage of proceedings and the authority named in the communication.
Check the officer’s current designation against the official communication and the relevant jurisdictional office.
Do not infer a changed filing deadline from Notification 133/2026 alone; verify the applicable notice, Act, Rules and current portal instructions.
Ahmedabad tax litigation: a document-first approach
For a taxpayer or business working with a CA in Ahmedabad, the safest workflow is to start with the record rather than a conclusion about forum or relief. Build a chronology of the notice, response, hearing opportunity, order and any subsequent demand or appeal communication. Then separate administrative-jurisdiction questions from substantive grounds such as computation, evidence, interpretation or limitation. Keeping those issues separate makes it easier to identify the correct next filing and avoid a response addressed to the wrong authority.
Checklist before relying on the notification
Read the notification together with the communication actually received by the taxpayer.
Confirm whether the matter concerns an appeal authority, an assessing authority or another administrative function.
Check current filing and response instructions on the official income-tax portal.
Obtain advice on the taxpayer’s specific facts before choosing rectification, appeal, stay or another remedy.
