BREAKING: Tax Audit Due Date Extended to October 21, 2026 & ITR Extended to November 21, 2026: Official CBDT Announcement
CBDT Official Announcement: Tax Audit Extended to October 21 & ITR to November 21
In a major statutory development announced today, September 28, 2026, the Central Board of Direct Taxes (CBDT), Ministry of Finance, Government of India, has officially postponed and extended the statutory deadlines for furnishing Tax Audit Reports and filing Income Tax Returns (ITRs) for Assessment Year 2026-27 (Financial Year 2025-26).
Following intense representations submitted by the Institute of Chartered Accountants of India (ICAI), industry bodies, trade chambers, and corporate tax practitioners regarding compressed timelines and e-filing portal latency, the CBDT has exercised its powers under Section 119 of the Income-tax Act, 1961, to grant comprehensive filing relief.
🏛️ Official Department Portal: Taxpayers and corporate finance teams can track official press releases and circular orders directly on:
Scope note: The CBDT announcement covers persons specified at S. No. 2 under Explanation 2 to section 139(1). It does not announce an extension for the separate transfer-pricing Form 3CEB deadline. A formal order/notification was stated to follow separately.
1. Statutory Due Date Comparison: Original vs. Officially Extended Dates
Statutory Filing Category: Tax Audit Reports (Form 3CA-3CD & 3CB-3CD) • Governing Section: Section 44AB • Original Statutory Due Date: 30th September 2026 • Officially Extended Due Date: 21st October 2026

Statutory Filing Category: Audited Non-Corporate Business Returns (ITR-5) • Governing Section: Section 139(1) • Original Statutory Due Date: 31st October 2026 • Officially Extended Due Date: 21st November 2026
Statutory Filing Category: Partner of Audited Firm / LLP Returns • Governing Section: Section 139(1) • Original Statutory Due Date: 31st October 2026 • Officially Extended Due Date: 21st November 2026
2. In-Depth Legal Analysis & Statutory Protections
A. Statutory Relaxation Under Section 119 of the Income-tax Act, 1961
Under Section 119(2)(a), the Central Board of Direct Taxes holds statutory jurisdiction to issue orders relaxing any requirement contained in any provision of the Act to avoid genuine operational hardship. The extension granted today legally binds all Assessing Officers, Faceless Assessment Units (FAU), and the Centralized Processing Centre (CPC) to treat filings submitted on or before the new dates as timely and valid.
B. Complete Statutory Immunity Against Section 271B Penalties
Under Section 271B of the Income-tax Act, failure to furnish a report of audit under Section 44AB by the prescribed statutory date exposes the enterprise to mandatory penalty:
Formula: Section 271B Penalty = \min(0.5\% × Total Turnover / Gross Receipts,\; ₹1,50,000)
With today's official postponement to October 21, 2026:
Any Tax Audit Report successfully submitted by the certifying Chartered Accountant and accepted by the client assessee on or before October 21, 2026, is fully protected.
No Section 271B penal proceedings or penalty notices can be initiated against compliant taxpayers.
C. Preservation of Business Loss Carry-Forward Under Section 80
Under Section 80 read with Section 139(3), business losses (Section 72), speculation losses (Section 73), and capital losses (Section 74) cannot be carried forward to subsequent assessment years unless the return of income is submitted within the prescribed statutory timeframe. Because the due date under Section 139(1) is now extended to November 21, 2026, all business loss carry-forward rights are legally preserved.
3. Immediate Action Plan for Corporate Assessees & Finance Teams
While this postponement provides crucial breathing room, corporate CFOs, finance controllers, and tax heads should maintain momentum:
Aim for October 21 Upload & DSC Acceptance:
Remember that a Tax Audit Report is legally complete only after both steps are executed:
Step 1: The practicing Chartered Accountant uploads the audited Form 3CD JSON and generates the UDIN on the ICAI portal.
Step 2: The corporate director, partner, or authorized signatory logs in to the e-filing portal and explicitly executes Digital Signature Certificate (DSC) Acceptance.
Ensure DSCs of directors/partners are active and registered on the portal well ahead of October 21.
Reconciliation of Clause Disallowances:
Ensure rigorous reconciliation between Form 3CD disallowances—specifically Section 43B(h) MSME payment disclosures, Section 40(a)(ia) TDS defaults, and Clause 44 GST expenditure reconciliations—and the computation of total income for the ITR.
Interest Liabilities Under Section 234A:
While filing deadlines are postponed, taxpayers with net self-assessment tax liability exceeding ₹1,00,000 should compute and deposit self-assessment tax immediately via Challan ITNS 280 to prevent escalating interest charges under Section 234A.
